Agreement to These Terms
These Terms of Service ("Terms") are an agreement between you and YTD Labs ("YTD Labs," "we," "our," or "us"). They govern your use of the TCGster mobile app, website, APIs, and related services (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Eligibility and Accounts
You must be at least 13 years old, or the higher minimum age required where you live, to use the Service. If you are not old enough to enter into a binding agreement, a parent or legal guardian must review and agree to these Terms for you.
You may begin with an anonymous account and may later connect an Apple or Google account. You are responsible for activity under your account, for safeguarding access to your device and credentials, and for providing accurate information. Tell us promptly if you believe your account has been compromised.
The Service
TCGster helps identify trading cards, display market-price information, and organize a digital collection. Features, supported card games, data sources, and availability may change over time. We may set reasonable usage limits or require a subscription for certain features.
Card Identification and Price Information
Scan matches, card details, variants, grades, and prices are generated from automated systems and third-party data. They may be delayed, incomplete, or incorrect. TCGster does not authenticate cards, provide certified grading, perform formal appraisals, guarantee market value, or guarantee that a card can be bought or sold at a displayed price.
You are responsible for checking the card, variant, condition, currency, date, and relevant marketplace before making a purchase, sale, insurance, tax, or other financial decision. The Service is provided for informational and collection-management purposes, not as financial, investment, tax, or legal advice.
Subscriptions and Billing
Some features require an auto-renewing subscription purchased through the Apple App Store or Google Play. The price, billing period, trial or introductory terms, and included features are shown before purchase. Your subscription renews automatically unless you cancel it through the applicable store before renewal. The store controls billing, cancellation, and refunds under its own terms.
A free trial, if offered, converts to a paid subscription unless canceled before the trial ends. Deleting the app or your TCGster account does not cancel a subscription. You must cancel through your App Store or Google Play subscription settings. Premium access may continue until the end of the paid period after cancellation.
Your Content
"Your Content" includes card images, collection information, tags, notes, feedback, and other material you submit to the Service. You retain your rights in Your Content. You grant YTD Labs a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, transmit, and display Your Content only as reasonably necessary to provide, secure, maintain, and improve the Service.
You are responsible for Your Content and must have the right to submit it. Do not upload images containing people, confidential documents, sensitive personal information, unlawful material, or content unrelated to the Service. We may remove or restrict content that violates these Terms or creates legal, security, or operational risk.
Acceptable Use
You agree not to:
- Use the Service unlawfully, fraudulently, or to violate another person's rights.
- Upload malicious code or content that is infringing, deceptive, abusive, or otherwise unlawful.
- Probe, bypass, disable, or interfere with authentication, security, rate limits, or access controls.
- Reverse engineer or attempt to extract source code except where applicable law expressly permits it.
- Use bots, scrapers, or automated access without our written permission.
- Resell, sublicense, copy, or commercially exploit the Service or its data except as expressly permitted.
- Overload, disrupt, or damage the Service or another user's experience.
- Misrepresent scan results or displayed prices as certified grades, guaranteed appraisals, or binding offers from YTD Labs.
Our Intellectual Property
The Service, including its software, design, branding, and original content, is owned by YTD Labs or its licensors and is protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use the Service for its intended purpose.
Trading-card names, artwork, images, logos, and other third-party materials belong to their respective owners. Their appearance in the Service does not transfer ownership to us or you. TCGster is an independent service and is not endorsed by or affiliated with card publishers, marketplaces, grading companies, Apple, or Google unless we expressly say otherwise.
Third-Party Services
The Service relies on third parties for authentication, card data, image recognition, AI processing, analytics, cloud infrastructure, subscriptions, and app distribution. Their services and content may be subject to separate terms and privacy policies. We are not responsible for third-party services that we do not control.
Service Availability and Changes
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features for maintenance, security, legal, provider, or product reasons. Where reasonably practicable and legally required, we will provide notice of material changes that negatively affect paid features.
Suspension, Termination, and Account Deletion
You may stop using the Service at any time and can delete your account in the app. We may suspend or terminate access if you materially or repeatedly violate these Terms, create risk or harm, fail to pay applicable fees, or if required by law. Where appropriate, we will provide notice and an opportunity to address the issue.
Sections that by their nature should survive termination will remain effective, including intellectual property, disclaimers, limitations of liability, and dispute terms. Account deletion is handled as described in our Privacy Policy and does not cancel an app-store subscription.
Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available." YTD Labs disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We do not warrant that the Service or any identification, price, collection total, or third-party data will be accurate, complete, current, secure, or uninterrupted.
Some jurisdictions do not allow certain warranty exclusions. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, YTD Labs and its directors, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the Service.
To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of the amount you paid for the Service during the 12 months before the event giving rise to the claim or US $100. These limitations do not apply where liability cannot lawfully be limited, including certain liability for fraud, willful misconduct, personal injury, or violation of mandatory consumer rights.
Your Responsibility
To the extent permitted by law, you are responsible for losses and reasonable costs arising from your unlawful use of the Service, Your Content, or your material breach of these Terms. This does not require you to compensate us for losses caused by our own conduct.
Disputes and Applicable Law
Applicable law determines which laws and courts govern these Terms and any dispute. Nothing in these Terms limits mandatory consumer protections or your right to bring a claim in a forum available under applicable law. Before filing a formal claim, you and YTD Labs agree to try in good faith to resolve the dispute by contacting the other party, unless applicable law allows you to proceed directly.
General Terms
These Terms and the Privacy Policy are the entire agreement between you and YTD Labs concerning the Service. If a provision is unenforceable, the remaining provisions stay effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition, reorganization, or sale of assets, subject to applicable law.
Changes to These Terms
We may update these Terms as the Service or legal requirements change. We will post the revised Terms, update the date above, and provide additional notice when required. If you continue using the Service after updated Terms take effect, you accept the updated Terms. If you do not agree, you must stop using the Service.
